These Terms of Service (“Terms”) govern your access to and use of thesadisticbrat website, memberships, livestreams, video-on-demand content, digital products, merchandise, community features, and related services (collectively, the “Services”).

PLEASE READ THESE TERMS CAREFULLY.

BY CLICKING “I ACCEPT,” CREATING AN ACCOUNT, PURCHASING A PRODUCT, SUBSCRIBING TO A MEMBERSHIP, OR OTHERWISE ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM, TOGETHER WITH OUR PRIVACY POLICY (COLLECTIVELY, THE “TERMS”).

If you are not eligible to use the Services or do not agree to these Terms, you may not access or use the Services.

1. ADULTS ONLY

The Services are intended exclusively for adults.

You must be at least eighteen (18) years old or have reached the age of majority required to enter into this Agreement in your jurisdiction, if higher.

By accessing or using the Services, you represent and warrant that you satisfy these age requirements and are legally capable of entering into a binding agreement.

Persons who do not satisfy these requirements are prohibited from accessing or using the Services.

thesadisticbrat reserves the right to restrict or terminate access where there is reason to believe a user does not meet applicable age requirements.

2. ACCOUNTS

Certain portions of the Services may require you to create or maintain an account.

You are responsible for providing accurate information, maintaining the confidentiality and security of your account credentials, and all activity occurring through your account.

Accounts are intended for use by the registered account holder only. You may not sell, transfer, lend, sublicense, or share your account or login credentials with another person.

You must promptly notify us if you believe your account has been accessed or used without authorization.

We may restrict access to content or request that Fourthwall take appropriate account-related action where reasonably necessary in connection with violations of these Terms, unauthorized access, account sharing, fraud, piracy, or other misuse.

3. MEMBERSHIPS

thesadisticbrat offers paid membership providing access to certain exclusive content and benefits.

At present, membership primarily provides access to eligible video-on-demand (“VOD”) content, including archived livestreams and livestream reruns.

The membership benefits displayed at the time of subscription describe the benefits then being offered. As the Services expand, membership offerings, features, and benefits may be modified, expanded, replaced, or discontinued prospectively.

Membership does not guarantee:

• any minimum number of livestreams, uploads, videos, or posts;
• any particular publishing or streaming schedule;
• the continued availability of any specific video or piece of content;
• personal communication or individualized interaction with thesadisticbrat; or
• any benefit not expressly included in the applicable membership description.

thesadisticbrat is responsible for delivering the membership benefits advertised by thesadisticbrat.

Membership structure, pricing, content, and benefits may change prospectively as the Services evolve. Any changes affecting billing or existing subscriptions will be handled in accordance with applicable law and the requirements of the platform through which the membership is provided.

4. RECURRING BILLING AND CANCELLATION

Memberships are recurring subscriptions unless expressly identified otherwise at the time of purchase.

By purchasing a recurring membership, you authorize Fourthwall and its applicable payment providers to charge the payment method associated with your account at the price and frequency disclosed at checkout until the membership is canceled.

You may cancel your membership through the subscription-management options provided by Fourthwall.

Unless otherwise required by applicable law or stated at checkout, cancellation prevents future renewals and does not terminate access for the remainder of an already-paid membership period.

Membership charges are generally non-refundable once charged, except where a refund, cancellation, withdrawal, or other remedy is required by applicable law or provided under Fourthwall’s applicable transaction policies.

No prorated refund or credit is provided merely because you did not use the membership benefits during an active membership period.

5. FOURTHWALL; PAYMENTS AND TRANSACTIONS

thesadisticbrat uses services provided by Fourthwall, Inc. (“Fourthwall”) to operate certain storefront, membership, payment, commerce, and fulfillment functions.

Fourthwall, not thesadisticbrat, is the seller of Products and Memberships purchased through the Fourthwall-powered Creator Site.

Transactions processed through Fourthwall are subject to Fourthwall’s applicable terms, policies, checkout disclosures, and other conditions presented in connection with the transaction.

Fourthwall and its service providers may be responsible for functions including payment processing, merchant-of-record services, applicable tax collection, subscription administration, refunds, returns, order processing, and merchandise fulfillment.

thesadisticbrat does not independently process payment-card information through these transactions and is not the manufacturer, payment processor, shipping carrier, or fulfillment provider merely because a product or membership is offered under thesadisticbrat brand.

thesadisticbrat remains responsible for providing the membership benefits advertised by thesadisticbrat.

These Terms govern your relationship with thesadisticbrat concerning access to thesadisticbrat content, intellectual property, community participation, and the benefits provided by thesadisticbrat. They do not replace any separate terms governing your transaction or account relationship with Fourthwall.

6. VIDEO-ON-DEMAND AND LIVESTREAM CONTENT

Membership may provide access to livestream recordings, archived broadcasts, VODs, clips, videos, and related media.

Content availability may change over time.

Videos and other materials may be added, updated, reorganized, replaced, temporarily unavailable, or removed from the library.

Unless expressly stated otherwise at the time of purchase, membership does not guarantee permanent availability of any particular video, livestream, recording, series, archive, or other item.

Temporary interruptions, maintenance, technical failures, third-party hosting issues, or changes to individual items of content do not automatically entitle a member to a refund except where required by applicable law or Fourthwall’s applicable policies.

7. PERSONAL VIEWING LICENSE

Access to membership content, livestream recordings, VODs, and other protected digital content is licensed solely for your personal, private, non-commercial viewing.

Purchasing a membership or digital product does not transfer ownership of the underlying content or intellectual property.

Except where expressly authorized in writing by thesadisticbrat, you may not:

• screen-record or otherwise capture protected video or audio;
• reproduce or copy content;
• download content unless downloading is expressly enabled;
• redistribute, transmit, publish, upload, mirror, or repost content;
• publicly display or publicly perform content;
• sell, rent, sublicense, trade, or otherwise commercially exploit content;
• share private video URLs, embed URLs, access tokens, or other restricted links;
• share membership credentials or permit another person to use your membership;
• circumvent or attempt to circumvent paywalls, access controls, domain restrictions, technical protections, or security measures; or
• assist another person in obtaining unauthorized access to protected content.

Unauthorized reproduction or distribution may violate copyright and other intellectual-property laws.

Where thesadisticbrat reasonably determines that an account or membership has been used for piracy, unauthorized distribution, credential sharing, or circumvention of access controls, access to thesadisticbrat content and membership benefits may be immediately revoked and thesadisticbrat may request or take appropriate account action through Fourthwall.

Access terminated for such violations will not be refunded by thesadisticbrat, subject to applicable law and Fourthwall’s applicable policies.

thesadisticbrat reserves all rights and remedies available under applicable law.

8. LIVESTREAM RECORDING AND PARTICIPATION

Livestreams may be recorded, archived, edited, clipped, excerpted, and made available as VOD content.

If you voluntarily participate in a livestream or related interactive feature, including through your username, display name, chat messages, comments, questions, reactions, submissions, or other contributions, you understand that those contributions may appear in the live broadcast and resulting recording.

By voluntarily submitting such contributions in connection with a livestream or community feature, you grant thesadisticbrat a non-exclusive, worldwide, royalty-free license to reproduce, display, distribute, edit, excerpt, and otherwise use those contributions as incorporated into or in connection with:

• livestreams;
• archived broadcasts;
• VODs;
• highlights;
• clips;
• compilations;
• promotional materials; and
• social-media or marketing content relating to thesadisticbrat.

This permission does not transfer ownership of intellectual property you independently own outside the contribution.

Do not submit information or material that you do not want potentially included in recorded or promotional content.

9. DIGITAL PRODUCTS AND INDIVIDUAL PURCHASES

thesadisticbrat may offer individual digital products in addition to memberships, including downloadable files, videos, recordings, media, or other digital materials.

Unless expressly stated otherwise, purchasing a digital product grants you a limited, non-exclusive, non-transferable, non-sublicensable license for personal use only.

Ownership and copyright remain with thesadisticbrat or the applicable rights holder.

A digital product identified as a download may be downloaded for personal use in accordance with the license accompanying that product.

A digital product identified as streaming-only does not grant a right to download or permanently retain the underlying media.

Digital-product transactions processed through Fourthwall remain subject to Fourthwall’s applicable transaction terms and policies.

Except where required by applicable law or provided under Fourthwall’s applicable policies, digital purchases are generally final once access or delivery has been provided.

10. MERCHANDISE AND FULFILLMENT

Physical merchandise available through the Fourthwall-powered Creator Site is sold by Fourthwall and may be manufactured, processed, shipped, or fulfilled by Fourthwall and its suppliers, manufacturers, shipping carriers, or fulfillment partners.

Applicable merchandise orders, payments, shipping, cancellations, returns, replacements, and refunds are handled according to Fourthwall’s applicable terms and policies.

Shipping and delivery estimates are estimates unless expressly stated otherwise.

Issues involving defective, damaged, incorrect, missing, or undelivered merchandise should be reported through the support process applicable to the Fourthwall order.

thesadisticbrat is responsible for creator-controlled aspects of the merchandise offering, such as creator-provided designs and descriptions, where applicable, but does not personally manufacture, process, ship, or fulfill Fourthwall merchandise unless expressly stated otherwise.

11. REFUNDS

Transactions processed by Fourthwall are subject to Fourthwall’s applicable refund, cancellation, return, and transaction policies.

Membership and digital-content purchases are generally non-refundable once charged or delivered except where otherwise required by applicable law or where Fourthwall provides a refund, cancellation, withdrawal, replacement, or other remedy under its applicable policies.

Physical merchandise returns, replacements, cancellations, and refunds are handled according to the terms applicable to the particular Fourthwall transaction.

Nothing in these Terms limits any non-waivable refund, cancellation, withdrawal, or consumer-protection right provided by applicable law.

12. PAYMENT DISPUTES AND CHARGEBACKS

If you believe a charge is incorrect, unauthorized, duplicated, or otherwise problematic, please contact the appropriate Fourthwall support channel or thesadisticbrat support so the issue can be investigated or directed appropriately.

Fraudulent, knowingly false, or abusive payment disputes and chargebacks are prohibited.

A chargeback, payment reversal, or other payment dispute may result in suspension of the associated membership, account, order, digital access, or membership benefits while the matter is investigated.

Where fraud or abuse is established, thesadisticbrat may revoke access to creator-provided content and request or take appropriate action through Fourthwall.

Nothing in this section prevents you from exercising legitimate rights available through your payment provider or applicable consumer-protection law.

13. COMMUNITY CONDUCT

Users must interact with the Services and other users lawfully and responsibly.

You may not use the Services to engage in:

• harassment, stalking, intimidation, or credible threats;
• hate speech or unlawful discrimination;
• doxxing or publishing another person’s private identifying information without authorization;
• impersonation or fraudulent misrepresentation;
• spam or unauthorized commercial solicitation;
• malicious links, malware, or attempts to compromise accounts or systems;
• illegal activity;
• infringement of copyright, trademark, privacy, publicity, or other rights;
• unauthorized collection of information about other users;
• interference with the normal operation of the Services; or
• conduct that violates applicable Fourthwall platform policies.

thesadisticbrat may moderate, hide, remove, or restrict user contributions and may restrict access to creator-provided content or request appropriate account action for violations of these Terms.

14. USER SUBMISSIONS

You retain ownership of original content that you submit where you otherwise own the applicable rights.

When you voluntarily submit content for publication, display, interaction, participation, or consideration through the Services, you grant thesadisticbrat the permissions reasonably necessary to host, reproduce, display, format, moderate, and distribute that submission in connection with operating the Services.

The additional license described in Section 8 applies to contributions made in connection with recorded livestreams and promotional use.

You represent that you have the rights and permissions necessary to submit any content you provide and that its permitted use will not violate another person’s rights.

15. INTELLECTUAL PROPERTY

Except for user-owned submissions and third-party materials, thesadisticbrat content — including videos, livestreams, recordings, photographs, graphics, artwork, logos, branding, designs, text, audio, compilations, and other creator materials — is owned by or licensed to thesadisticbrat and is protected by applicable intellectual-property laws.

“thesadisticbrat,” associated branding, logos, graphics, and other brand identifiers may not be copied, reproduced, imitated, or commercially used without authorization.

No rights are granted except the limited rights expressly provided in these Terms.

16. COPYRIGHT COMPLAINTS

thesadisticbrat respects intellectual-property rights.

If you believe material made available by thesadisticbrat infringes copyright or another intellectual-property right, contact:

Your notice should provide sufficient information to identify the protected work, the allegedly infringing material, your contact information, and the basis for your claim.

Additional information may be requested where required to process the complaint under applicable law or the policies of the platform hosting the material.

17. 18 U.S.C. §§ 2257 AND 2257A

The Services are restricted to adults.

To the extent any content made available through the Services is subject to the recordkeeping or disclosure requirements of 18 U.S.C. §§ 2257, 2257A, or applicable regulations, required records and disclosures will be maintained or provided in accordance with applicable law.

Where legally required, additional information concerning the location and custodian of applicable records will be provided through the appropriate compliance statement.

Nothing in this section should be interpreted as a representation that every item of content available through thesadisticbrat is subject to these requirements.

18. THIRD-PARTY SERVICES

The Services may rely upon or integrate services operated by third parties, including Fourthwall, payment processors, fulfillment providers, video-hosting providers, content-delivery networks, analytics providers, and other technology providers.

Your use of certain third-party features may also be subject to that provider’s terms and privacy practices.

thesadisticbrat does not control third-party platforms and cannot guarantee that any third-party service will remain continuously available, error-free, compatible with every device, or unchanged.

A third party may experience outages, discontinue features, change technical requirements, restrict access, or otherwise affect portions of the Services.

19. TECHNICAL REQUIREMENTS

Access to digital content may require a compatible device, supported browser, internet connection, software, cookies, JavaScript, or other technical functionality.

thesadisticbrat does not guarantee compatibility with every device, browser, operating system, VPN, network configuration, browser extension, ad blocker, privacy tool, or other software.

Users are responsible for maintaining the equipment and internet access necessary to use the Services.

20. NO PERSONAL OR PROFESSIONAL RELATIONSHIP

Purchasing a membership, merchandise, digital content, or otherwise accessing or interacting with the Services does not create an employment, agency, partnership, joint venture, fiduciary, therapeutic, advisory, personal, romantic, or other special relationship between you and thesadisticbrat.

Membership does not entitle a member to private communication, personal attention, individualized responses, private interaction, or access to thesadisticbrat beyond the benefits expressly described in the applicable membership offering.

21. ENTERTAINMENT PURPOSES

Content available through the Services may include entertainment, commentary, humor, opinions, personal experiences, challenges, discussions, or other expressive content.

Such content is provided for entertainment and informational purposes and should not be treated as individualized medical, psychological, legal, financial, or other professional advice.

22. PROHIBITED USE

In addition to other restrictions in these Terms, you may not use the Services or thesadisticbrat content to:

• violate applicable law;
• violate another person’s rights;
• obtain unauthorized access to accounts, content, systems, or data;
• scrape, harvest, systematically copy, or extract protected content or user information without authorization;
• reverse engineer or interfere with security or access controls;
• distribute malicious software;
• commit fraud or payment abuse;
• falsely represent an affiliation with thesadisticbrat;
• use protected content to train, develop, or populate commercial datasets, machine-learning systems, generative-AI systems, facial-recognition systems, or similar technologies without express written permission; or
• facilitate another person’s violation of these Terms.

23. SUSPENSION AND TERMINATION

thesadisticbrat may restrict or revoke access to creator-provided content and membership benefits, and may request or take appropriate action through Fourthwall, where reasonably necessary to address:

• violations of these Terms;
• piracy or unauthorized distribution;
• account sharing;
• fraud or abusive chargebacks;
• security threats;
• unlawful conduct;
• harassment or serious community misconduct; or
• misuse that threatens thesadisticbrat, other users, the Services, or third-party providers.

Where access to creator-provided benefits is revoked because of a user’s violation of these Terms, thesadisticbrat does not provide a refund except where required by applicable law. Any refund or transaction remedy administered by Fourthwall remains subject to Fourthwall’s applicable policies.

Termination does not eliminate obligations or liabilities that arose before termination.

Provisions that by their nature should survive termination — including intellectual-property provisions, licenses already granted, payment obligations, limitations of liability, dispute provisions, and restrictions concerning previously obtained content — will survive.

24. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THESADISTICBRAT CONTENT, BENEFITS, AND CREATOR-PROVIDED PORTIONS OF THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

THESADISTICBRAT DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY OTHER WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED.

THESADISTICBRAT DOES NOT WARRANT THAT CREATOR-PROVIDED CONTENT OR FEATURES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM TECHNICAL PROBLEMS.

THIRD-PARTY PRODUCTS AND SERVICES MAY BE SUBJECT TO SEPARATE WARRANTIES, DISCLAIMERS, OR TERMS PROVIDED BY THE APPLICABLE THIRD PARTY.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

25. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THESADISTICBRAT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THESADISTICBRAT CONTENT, BENEFITS, OR CREATOR-PROVIDED PORTIONS OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THESADISTICBRAT’S AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THESADISTICBRAT’S CREATOR-PROVIDED SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID IN CONNECTION WITH THE SERVICES GIVING RISE TO THE CLAIM DURING THE SIX MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR $100 USD.

These limitations do not apply where liability cannot legally be limited or excluded.

26. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless thesadisticbrat and its owners, representatives, contractors, and agents from claims, damages, liabilities, losses, and reasonable costs arising from:

• your violation of these Terms;
• your unlawful use of thesadisticbrat content or Services;
• content you submit;
• your infringement of another person’s rights; or
• fraud, piracy, unauthorized distribution, or other intentional misuse of the Services.

27. CHANGES TO THE SERVICES AND MEMBERSHIP

thesadisticbrat may modify, update, redesign, expand, suspend, or discontinue creator-provided portions of the Services.

Content libraries, membership benefits, website features, livestream offerings, third-party integrations, and other creator-provided features may change as thesadisticbrat develops and expands.

thesadisticbrat may also introduce additional membership offerings or change the structure of future membership offerings.

Where applicable law or Fourthwall’s platform requirements require notice, consent, cancellation rights, or another procedure before a change becomes effective, those requirements will be followed.

28. CHANGES TO THESE TERMS

These Terms may be updated periodically to reflect changes to the Services, business practices, platform requirements, or applicable law.

The “Last Updated” date at the top of these Terms indicates when the Terms were most recently revised.

Material changes will be communicated where required by applicable law.

Your continued use of thesadisticbrat Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

29. PRIVACY

Your use of the Services is also subject to the applicable Privacy Policy.

Transactions, accounts, and features operated by Fourthwall or other third parties may additionally be governed by those providers’ privacy policies.

30. GOVERNING LAW

These Terms and disputes arising out of or relating to these Terms or thesadisticbrat's creator-provided Services will be governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Nothing in these Terms deprives a consumer of mandatory protections provided by the law of their jurisdiction where those protections cannot legally be waived.

31. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.

The affected provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted.

32. NO WAIVER

Failure by thesadisticbrat to enforce any provision of these Terms does not constitute a waiver of that provision or the right to enforce it later.

33. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any additional terms expressly presented by thesadisticbrat in connection with a particular creator-provided feature or offering, constitute the agreement between you and thesadisticbrat regarding your use of thesadisticbrat Services.

Transactions, memberships, merchandise, accounts, and other functionality provided or processed by Fourthwall may additionally be governed by Fourthwall’s applicable terms and policies.
